Il presente contributo dottrinale ravvisa il bene giuridico tutelato dall’art. 11 D. Lgs. 74/2000 nella garanzia del credito d’imposta dello Stato. Si osserva che il privilegio che assiste tale credito nelle procedure concorsuali, similmente agli altri privilegi, non esclude la par condicio creditorum, anzi ne è parte integrante. Ne deriva, secondo l’autore, che il reato di bancarotta fraudolenta per distrazione, che offende la garanzia patrimoniale di tutti i creditori, assorbe quello di sottrazione al pagamento di imposte, che offende la garanzia patrimoniale dell’erario. D’altronde egli osserva che gli atti fraudolenti, in qualunque fase compiuti, hanno le medesime caratteristiche, le quali in ultima analisi si possono riassumere nell’artificio che nasconde la finalità di depauperare il patrimonio a garanzia dei creditori, privati o pubblici che siano.

This article argues that the legal interest protected by Article 11 of Italian Legislative Decree No. 74/2000 is the safeguarding of the State’s tax claim. It contends that the statutory priority accorded to such claims in insolvency proceedings, like the system of priorities applicable to other preferential claims, does not derogate from the par condicio creditorum; rather, it constitutes an integral component of that principle. On this basis, the author submits that the offence of fraudulent bankruptcy by asset diversion (bancarotta fraudolenta per distrazione), which infringes the proprietary guarantee securing the claims of all creditors, subsumes the offence of fraudulent evasion of tax payment, which instead infringes the proprietary guarantee securing the Treasury’s tax claim. The article further argues that fraudulent acts, irrespective of the stage at which they are committed, share the same essential characteristics, ultimately consisting in a deceptive scheme designed to conceal the purpose of dissipating assets forming the common guarantee of creditors, whether public or private.
